1. General Provisions

1.1. These Terms and Conditions (hereinafter referred to as "Terms") govern the rights and obligations between the seller (Pavel Hazmuka – Sport Spa) and the buyer concerning the sale of goods through the online store at www.sport-spa.cz.

1.2. The buyer is either a non-business individual or a legal entity purchasing goods for personal use. Special conditions may apply to business entities.

1.3. The purchase agreement is concluded in English and is governed by the laws of the Czech Republic. All agreements may be concluded electronically.

1.4. These Terms are valid and binding as of the date of their publication. The seller reserves the right to update them. Buyers will be informed of changes through the website.

2. User Account

2.1. Buyers may create a user account for placing orders. Registration is optional, and purchases can also be made without an account.

2.2. Buyers must provide accurate information. Any changes must be reported to the seller immediately.

2.3. The seller reserves the right to delete accounts that remain inactive for more than 12 months or in case of a breach of these Terms.

2.4. Account access is protected by a password, and buyers are responsible for maintaining its confidentiality.

3. Conclusion of the Purchase Agreement

3.1. An order constitutes a proposal to conclude a purchase agreement. The agreement is finalized when the seller confirms the order via email.

3.2. The seller reserves the right to decline an order, particularly in cases of stock unavailability or technical issues.

3.3. Product and price information on the website is binding at the time of order submission.

3.4. Buyers bear the costs of using remote communication tools (e.g., internet or phone charges).

4. Prices and Payment Terms

4.1. Payment for goods can be made in the following ways:

In cash upon personal collection,
Cash on delivery (COD),
Bank transfer to the seller's account,
Through an online payment gateway,
Credit card payment online.

4.2. Prices include all applicable taxes and fees unless stated otherwise.

4.3. For bank transfers, payment must be made within 7 business days of order confirmation.

4.4. An electronic invoice will be sent to the buyer's email address.

5. Delivery of Goods

5.1. Goods are delivered to the address provided by the buyer via contracted carriers.

5.2. The standard delivery time is 2–5 business days from order confirmation unless stated otherwise for specific products.

5.3. Delivery costs are listed in the order summary.

5.4. Upon receipt, buyers are obliged to check the shipment for damages.

6. Withdrawal from the Contract (Returns)

6.1. Buyers have the right to withdraw from the purchase agreement without giving a reason within 14 days of receiving the goods.

6.2. Buyers may use the withdrawal form available here or notify the seller via email.

6.3. Returned goods must be undamaged, unused, and in their original packaging. Returns should be sent to the seller's registered address.

6.4. Buyers bear the cost of returning goods unless otherwise agreed.

6.5. Refunds will be issued within 14 days of receiving the returned goods.

7. Defective Performance Rights (Complaints)

7.1. Buyers are entitled to file a complaint if the goods are defective upon receipt or if defects occur during the warranty period.

7.2. Complaints can be submitted via email or in person at the seller's registered address.

7.3. Complaints will be resolved promptly, no later than 30 days after submission.

8. Personal Data Protection

8.1. The seller processes buyers' personal data in accordance with the GDPR and Act No. 110/2019 Coll. on personal data processing.

8.2. Buyers have the right to access, rectify, delete, or transfer their personal data.

9. Final Provisions

9.1. These Terms are effective from [27/11/2024] and supersede all previous provisions.

9.2. Buyers acknowledge these Terms as binding upon order confirmation.

9.3. Any disputes will be resolved under the laws of the Czech Republic.
